Defense relentless in questioning ex-Stanford exec (AP)

HOUSTON ? Liar. Hypocrite. Adulterer. Fraudster. Coward.

In relentless and sometimes contentions questioning, an attorney for jailed Texas tycoon R. Allen Stanford has sought to paint prosecutors’ star witness in the financier’s fraud trial as the true leader of a Ponzi scheme that authorities say took billions from investors.

Prosecutors allege Stanford led a 20-year scheme centered on the sales of certificates of deposit, or CDs, from his Caribbean bank on the island nation of Antigua and bilked investors out of more than $7 billion. But defense attorneys have tried to show that his former top money man, James M. Davis, was the one behind the alleged scheme.

Davis pleaded guilty to three fraud and conspiracy charges in exchange for a possible reduced sentence. Sanford attorney Robert Scardino told jurors Davis can’t be trusted because he will say anything to avoid a lengthy prison term.

Scardino even used Davis’ own words to try to illustrate their point that Stanford’s former top money man is untrustworthy. The defense attorney used a large drawing pad on an easel next to the witness stand to write down terms Davis has used to describe himself during his testimony, which was expected to continue for a fifth day Wednesday. The list of words stood next to Davis through much of his testimony Tuesday.

Davis repeatedly said he was telling the truth and would “rather spend the rest of my life in prison and be as free as I am now than to be bound the last 20 years as I was with Allen Stanford.”

Stanford’s attorneys contend the financier was a savvy businessman whose financial empire, headquartered in Houston, was legitimate and he could have paid back investors if authorities hadn’t seized his companies.

Authorities allege Stanford used depositors’ money to operate his businesses, pay for his lavish lifestyle, and bribe regulators and auditors. They also say he lied to depositors by telling them their money was being safely invested.

Stanford is on trial for 14 counts, including mail and wire fraud, and faces up to 20 years in prison if convicted. Stanford was once considered one of the United States’ wealthiest people, with an estimated net worth of more than $2 billion. He’s been jailed without bond since being indicted in 2009.

On Tuesday, Scardino claimed it was Davis alone who altered financial statements and other documents and requested that bribes be sent to an auditor as part of efforts to hide the alleged fraud at the bank.

Scardino also accused Davis of stealing $6 million that had been transferred in December 2008 from a secret Swiss bank account held by Stanford.

Davis, 63, said he didn’t steal the money and when questioned again by prosecutors clarified the $6 million had been transferred to another Swiss account held by Stanford’s other bank on Antigua. Davis said the money remained there until it was seized by authorities in February 2009.

Scardino presented to jurors a memo Davis wrote in February 2009 ahead of a meeting with potential defense attorneys in which he praised the bank’s operation’s, called Stanford a “gifted individual” and wrote there was “never a hint of criminal intent.”

Davis said when he wrote the memo, for a meeting both he and Stanford were to attend, he still hadn’t come clean about the fraud.

“I was still spinning the fraud, still lying,” he said.

Scardino also accused Davis of being a tax cheat and underreporting his income in 2006 by as much as $1.2 million. Davis said he’s paid more than $120,000 in back taxes.

Obama team returning money tied to casino owner (AP)

WASHINGTON ? President Barack Obama’s campaign is returning about $200,000 in contributions collected by family members of a Mexican casino owner who fled the U.S. after facing drug and fraud charges.

The Obama campaign said Monday it had decided to return the donations arranged by Chicago brothers Carlos Cardona and Alberto Rojas Cardona, who had begun raising money for the campaign and the Democratic National Committee last year.

The New York Times reported late Monday that the fundraisers are the brothers of casino owner Juan Jose Rojas Cardona, who skipped bail in Iowa in 1994 and has since been linked to violence and corruption in Mexico.

The campaign said it refunded the money raised by family members after the newspaper asked about the brothers’ fundraising role. Obama campaign officials said they were identifying donations bundled by other people connected to Cardona, expected to be about $100,000, and would return those funds as well.

“On the basis of the questions that have been raised, we will return the contributions from these individuals and from any other donors they brought to the campaign,” said Obama campaign spokesman Ben LaBolt.

The newspaper reported that Gordon Fischer, a lawyer and the former chairman of the Iowa Democratic Party, had sought a pardon for Juan Jose Rojas Cardona from Iowa Gov. Chet Culver, a Democrat, but none was granted.

Russia: Girls switched at birth get $100k each

It was more money than either family has ever seen ? but it’s still not clear if it can make the pain go away.

A court awarded two Russian families $100,000 each in compensation Monday from a maternity home that accidentally switched their daughters at birth. The parents said they could use the money to house the girls, now 12, next to each other.

The story has captivated Russia for ever since the families learned about the switch several months ago.

During divorce proceedings, one man refused to support his daughter Irina ? who has dark hair, dark eyes and olive skin ? because she didn’t look like him. A DNA test then revealed that neither he nor the mother, Yuliya Belyaeva, were Irina’s biological parents.

An official investigation then tracked down Irina’s biological father, Naimat Iskanderov, who had been raising Belyaeva’s own child, Anna, in a neighboring town.

Belyaeva said the news still makes her shiver.

“It is very unpleasant to relive those memories,” she told The Associated Press in a brief telephone interview. “We still can’t fully comprehend what happened.”

In video broadcast on Russia’s NTV television, Belyaeva laughed with joy Monday after the judge delivered the verdict in a courtroom in Kopeisk, an industrial town of 140,000 in Russia’s Ural Mountains, but Iskanderov remained stone-faced.

Fair-skinned Anna strongly resembles her biological mother Belyaeva, while Irina looks like her father Iskanderov, an ethnic Tajik born in the Central Asian and mostly Muslim ex-Soviet state of Tajikistan.

The video showed Belyaeva caressing Anna, while Irina, whom she raised, sat stern-faced with her eyes downcast.

“She feels jealous,” Belyaeva said in televised remarks.

Belyaeva married again after separating from her husband and gave birth to two more children. Iskanderov parted with his wife when Anna was five but later married again, according to the Komsomolskaya Pravda newspaper.

Despite the verdict, Belyaeva said the swap will leave lasting emotional scars.

“The money just can’t ease the pain,” Belyaeva said. “All the money in the world isn’t worth a child’s look at mother … there are moments when I think it would have been better if I hadn’t known anything about that.”

Russian television reports said the girls don’t want to leave the parents who raised them, so the families were thinking of using the compensation money, which is huge by Russian standards, to live near each other or even share a home.

“I would like us to share a house so that we don’t worry about her daughter coming to me and the other way round,” Iskanderov said on television.

His former wife and Belyaeva’s former husband were not present in the courtroom Monday and made no statements after the court ruling.

Belyaeva said she would prefer separate houses nearby, so that “we see our children growing up and take part in their education.”

Belyaeva also identified the nurse who she claimed mixed up the babies, but the nurse denied any responsibility.

“I know it was not me who did it,” nurse Nelly Prokopyeva told Russian television.

This is not the first time a Russian court decision has resolved a hospital mix-up.

In 2009, a court in the central Russian town of Mtsensk ordered two mothers to swap their two-year-old sons following a DNA test that proved the children were mixed up at a maternity hospital. The case was complicated by the ethnic and religious background of the women ? one of them was ethnic Russian and Orthodox Christian, while the other one was ethnic Chechen and Muslim.
